Terms of Service

1. Acceptance

By creating an account or using ProMark Works you agree to these Terms of Service. If you do not agree, do not use the platform.

2. What ProMark Works provides

ProMark Works is a software platform for residential home inspection and warranty management. We provide the tools — you provide the data and are responsible for how you use them.

3. Your account

• You must provide accurate information when creating an account
• You are responsible for keeping your password secure
• You are responsible for all activity that occurs under your account
• You must be 18 or older to create an account

4. Acceptable use

You agree not to:

• Use ProMark Works for any unlawful purpose
• Upload content that is false, misleading, or fraudulent
• Attempt to access another company's account or data
• Reverse engineer or copy the platform
• Resell or redistribute access to ProMark Works without written permission

5. Your data

You own your data. ProMark Works does not claim ownership of any property records, inspection findings, photos, or other content you upload. We store and process your data only to provide the service.

6. Billing

• The 30-day free pilot requires no credit card
• After the pilot, continued use requires a paid subscription
• Subscriptions are billed monthly
• You can cancel at any time — no cancellation fees
• Refunds are provided at our discretion for unused billing periods

7. Uptime and availability

We aim for high availability but do not guarantee 100% uptime. We are not liable for losses caused by platform downtime or data unavailability.

8. Limitation of liability

ProMark Works is provided as-is. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the amount you paid us in the 3 months prior to the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your account at any time by contacting Dhavalpatel@promarkworks.com.

10. Changes

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These terms are governed by the laws of the State of Delaware, United States.
